BHC reserves judgment

QUETTA Dec 19 (PPI): A two member bench of Balochistan High Court reserved judgment on application filed by Assistant Executive Officers seeking stay order against Government of Balochistan notification here Monday. Bench comprised Justice Naeem Akhtar Afghan and Justice Tahira Safdar.

Lawyer Waseem Sajjad apparel on behalf of Assistant Executive Officers while Advocate represented Government during the hearing.

In his arguments Waseem Sajjad requested the court to issue stay order about transfer of executive officers to their parent departments.

Lawyers leaders Abu Ghani Khilji Advocate, Muhammad Asif Reki Advocate, Muhammad Aamir Rana Advocate, nadir Chalgari Advocate, Naseebullah Tareen Advocate, Sanaullah Ababaki Advocate and Munir Kakar Advocate filed an application that they wanted to become party in the petition. Bench brought their application on record.

Kamran Murtaza Advocate also gave his comments in support of orders.

Lawyers representing Executive officers in their arguments said that the matter is already under hearing at the Apex Court and it has issued its clear orders to Government of Balochistan and the government has issued notification about posting of ex Cadre officers.

The bench reserved its judgment on this constitutional petition.

It is added here that 71 Assistant Executive Officers were issued orders from removing them from Cadre posts on the orders of Supreme Court. Following these orders Government of Balochistan has issued notification for transferring 71 Assistant Executive Officers from cadre posts and directed them to report to S&GAD. These officers approached High Court and adopted stance they should not be returned.

Speaker with Newsmen after hearing, Lawyers of Balochistan Services Association, Balochistan Secretariat Association and Balochistan Secretariat Staff Association expressing satisfaction over hearing of their case at the High Court said government of Balochistan has not yet fully implemented Supreme Court orders and these officers have been directed to report to S&GAD instead of their departments Finance and Planning.

They said we are not satisfied with this notification of Government of Balochistan and we would go to Supreme Court against it where we would take stand at the Court were being joked and its orders were not implemented in true spirit. Despite clear orders of Supreme Court and government of Balochistan these ex-cadre officers were still working on their posts illegally. It not only tentamounts as contempt of court but joke with Government of Balochistan notification and legal action would be taken against it.
